The Democrats’ healthcare reform bill has been touted as the solution for Americans with pre-existing conditions that make them “uninsurable” in the eyes of private health insurance companies. Normally, underwriters for health insurance plans consider consumers with serious health problems as too high a risk to take on; they profit by collecting premiums while paying as few claims as possible. This has put much of our population in a quandary and helped fuel our current health care crisis. Indeed, it does include a ban on insurers denying coverage based on health status. In addition, it will provide subsidies for those who have been turned down when applying for insurance. Unfortunately, the proposals aren’t exactly the panacea promised by the Obama administration and Democratic congresspersons.

It’s bad enough that the full healthcare bill, including the requirement to provide people with pre-existing conditions access to health insurance, won’t take effect until 2013. From a political standpoint, either its success can’t be used to boost President Obama’s re-election campaign, or its failure will be the responsibility of someone else if Obama is out of office. Recognizing the need for some immediate help, Congress provided for a high-risk insurance pool–similar to those proposed by Republican John McCain during the 2008 presidential campaign–in the meantime. Over half of the states in America already have high-risk health insurance pools for their residents. It costs them a total of $1 billion to insure about 200,000 patients. Expanding that system on a national level will be difficult.

However important immediate health coverage is, the Senate version has some strings attached. The Senate bill forces patients to wait six months before entering the pool. Medical advocates point out that for many conditions, such as cancer, the afflicted need medical care immediately and can’t spend several months without health insurance while hoping they survive long enough to take advantage of the government’s pool. The House of Representatives is against such a waiting period, but the Senate claims it’s necessary to stop people from dropping their more costly health insurance plans in favor of the government’s. The House understands that the healthcare reform bill, already costing over $1 trillion, needs to conserve cash wherever it can while maintaining quality. Instead of requiring a waiting period to enter the high-risk pool, their bill would penalize insurance companies that dump such patients. The health insurance plans guilty of that practice will then have to pay into the government’s pool.

In order to cover the one million uninsured Americans with pre-existing conditions, the program would need about $7 to $10 billion per year. The biggest problem with the high-risk pools is that Congress has only budgeted $5 billion for each year of the pool, which will be phased out after the rest of the healthcare reform bill (including the public option) takes effect in 2013. The government could make do with that budget if historical trends hold, with only a small percentage of people taking advantage of the government benefits they are entitled to. It appears that operating on such a belief defeats the purpose of the Democratic legislation in the first place. They want to increase access to healthcare, but are working under the assumption that a significant portion of the people who need the federal high-risk health insurance plan won’t sign up? Something doesn’t seem right about that.

Far more people today are choosing to use private medical insurance rather than the National Health Service. Normally self pay refers to the payment of a surgery on a one off basis.

Is there that much wrong with our national health service however? Well fundamentally no, the majority of people are going private not because the healthcare is better, but generally because it is faster. An often cited example is that of the waiting lists for hip replacements. Currently these are some of the longest waiting lists on the NHS and considering a new hip can be a life changing operation, waiting can be extremely debilitating. While you may have to pay a premium, being treated privately will be considered by many to be a more worthwhile option.

When residents were forced to flee from their homes, some left behind necessary and valuable prescription medications. Blue Cross of California also extended the range of in-network healthcare providers to help those who were forced to relocate. Anthem said the in-network coverage benefits would be extended to cover out-of-network providers when victims of the wildfires relocated to areas lacking in-network providers.

Anthem also extended assistance to the community at large. Blue Cross of California donated $25,000 to the American Red Cross to help bring relief to victims of the southern California fires.

Safety is always a priority for drivers. This is especially true for those transporting hazardous materials. Strict adherence to federal and state hazmat regulations is imperative. Failure to comply with these regulations can result in stiff fines and penalties, including being barred from working with commercial transports.

The Federal Motor Carrier Safety Administration requires that all trucks transporting hazardous materials have this fact clearly marked for other drivers. Drivers must always be in compliance with state and local traffic regulations.

When an accident takes place involving hazardous materials, it is important to notify all of the proper authorities. While it is important to notify your truck insurance provider as soon as possible, they are usually one of the last agencies that should be contacted. After emergency services have been contacted, but no later than 12 hours following the accident, the first agency you should contact is the Department of Transportation (DOT) National Response Center (NRC), followed by the Center for Disease Control and Prevention (CDC) if the incident involves etiologic agents.

These agencies should be immediately contacted in the following instances:
-A person is killed.
-A person receives an injury requiring hospitalization.
-There in an evacuation of the general public for one hour or more.
-A major transportation route is blocked or inaccessible for more than one hour.
-Fire, breakage, spillage, or possibly contamination occurs with a radioactive cargo.
-The spill of a marine pollutant occurs in a quantity greater than 450 L (119 gallons) of liquid material or 400 kg (882 lbs.) of solid material.

-The driver deems that there is a threat to life not covered in the previous criteria.

The first report will be made by telephone. The NRC reporting number is (800) 424-8802, and the CDC reporting number is (800) 232-0124. It is important to have these numbers available at all times. Be sure to have all information prepared before calling. The information needed in this report will be:

1. Name of Reporter.
2. Name and address of person represented by reporter.
3. Phone number where reporter can be contacted.
4. Date, time, and location of incident.
5. The extent of injury, if any.
6. Class or division, proper shipping name, and quantity of hazardous materials involved if that information is immediately available.
7. The nature of the incident and whether a threat to life still exists at the scene.

The second report that needs to be filed will be DOT Form F 5800.1. It must be submitted within 30 days. In addition to the above circumstances, this form must be submitted after the following events:

-The unintentional release or discharge of hazardous materials or waste.
-A specification cargo tank with a capacity of 1,000 gallons or greater containing any hazardous material suffers structural damage to the lading retention system or damage that requires repair to a system intended to protect the lading retention system, even if there is no release of hazardous material.
-Undeclared hazardous materials are discovered.

There are many different types of insurance coverage which may be applicable after your auto accident. They may include:

(1) Your Personal Auto Policies: Your insurance company may extend benefits to you after an accident, even when the accident is not your fault or when you were a passenger in another vehicle. It is important to look at your policy before calling your insurance company to file a claim. You may be entitled to the following types of coverage:

– Med Pay: If you elected to obtain Medical Payments coverage under your auto policy, your insurance company will pay up to the limits of the policy for your necessary accident-related medical expenses. This coverage may apply even when you are hurt while a passenger in another vehicle. Check your policy to determine what these limits are. Keep in mind that most policies will require that you repay your carrier for these expenses advanced out of the proceeds of your settlement.

– Collision: Your auto policy may also repair and/or replace your vehicle even when another driver hit you. Typically, they will do this when it is not clear who is at fault for the accident. It is then the insurance company’s responsibility to take the insurance company for the at-fault driver to an arbitration hearing to determine who will ultimately pay for the accident related vehicle damages.

– Rental Reimbursement: You may also be entitled to payment for your rental car expense while your own vehicle is being repaired.

– UM/UIM: Hopefully, you purchased Uninsured/Underinsured Motorists coverage at the time you bought your policy. The uninsured motorist coverage (UM) will pay for your damages in the event that the driver that caused the accident did not have the minimum required liability coverage in place. The underinsured coverage (UIM) will pay for your damages in the event that the other driver had liability coverage limits lower than that of your own policy and assuming that your damages are greater than the amount of liability coverage held by the at-fault driver. Again, this coverage may even apply when you are a passenger in someone else’s vehicle.

(2) The Auto Policy covering the vehicle in which you were a passenger: As a passenger in a vehicle covered by an auto insurance policy you are also entitled to benefits under the policy of auto insurance covering that vehicle.

– Liability Coverage: If the driver of the vehicle you were in as a passenger is at fault for the accident, the liability coverage attached to that policy would be responsible for paying your damages.

– Med’Pay & UM/UIM: As a passenger you are also entitled to the same Med-Pay and UM/UIM benefits as the policyholder.

(3) The At-Fault Driver’s Auto Liability Policy: The policy of insurance covering either the at-fault driver or the at-fault vehicle will be responsible for paying for your damages sustained as a result of the accident. These generally fall into two categories:


– Property Damage: Liability insurance is meant to cover the cost of repairing or replacing your damaged vehicle. Also available will be damages for the loss of use of your vehicle while it is being repaired or until the settlement is reached on the property damage if the vehicle is declared a total loss. Settlement of this category of damages is usually reached within days or weeks of the accident.

– Bodily Injury: This category of damages generally includes payment for your medical expenses, physical injuries, pain and suffering, lost wages, loss of earnings capacity and other economic losses. Settlement negotiations for these types of damages should not take place until your doctors have completed your course of medical treatment. In many cases, insurance adjustors for the other side will either delay settlement or make “low-ball” offers requiring the commencement of litigation to resolve the case.

(4) Your Health Insurance Policy: In the event that you had a health insurance plan in effect at the time of the accident, this coverage will pay for your medical expenses as you continue your medical treatment. Please note that, in most cases, this coverage is not triggered until all available auto Med-Pay coverage has been spent.

Caution: It is very important to note that most health policies have a “subrogation clause” which requires you to pay back the insurance company for the amounts that they have paid towards your medical expenses once you collect any money from the liability insurance carrier. Failure to comply with these policy requirements can result in your health carrier canceling your insurance or filing a lawsuit against you. Consequently, it is strongly recommended that you consult with an attorney to determine how to proceed in this situation. Additionally, an experienced attorney may be able to convince the health carrier to waive or reduce the amounts.

(5) Your Disability Policy: If your injuries prevent you from returning to work after the accident, you may be able to make a claim for either permanent or temporary disability under any disability policies that you had in effect at the time of the accident.

(6) Worker’s Compensation Plans: If you were involved in an accident while you were on the job, your employer’s worker’s compensation plan will extend benefits for your medical bills and loss of earnings. It is very important to speak with an attorney as soon as possible in these situations, as the coordination of your rights between your worker’s compensation case and your personal injury case is essential.

Caution: Coordination of benefits between all the potential insurance policies is an area requiring specialized legal knowledge. It is very easy to overlook possible avenues of recovery if you are not intimately familiar with this area of law.
